I can't wait to see the end of this one. I was a Smog Technician in California for over 20 years. The State would have fined me from 30 to 60 Thousand for a conviction of tampering". My boss got stuck with an 'undercover car' from the EPA, and even tho he found their "problem" and fixed it, he did not follow "procedures" and Fail it first, then get an OK to fix it, so they fined him 5000 bucks.
The "Bearu" as we called them are actively seeking even the most minor violations to cite and fine.
For VW to do this is unbelieveable.

Fun notes:
-VW's diesels have a reputation for getting better then EPA window sticker MPG (now we know why).
-VW's diesels may not actually be able to run much longer than the standard test with the he emissions equipment operating properly.
-Some knowledgable sources suggest the vehicles may effectively be undrivable with the emissions gear functioning, even if they can keep running.
-VW sold almost 500,000 vehicles in the US with a window sticker that promised X horsepower from their engine, an amount it is likely they cannot produce with the emissions gear functioning.
-Many owners will elect NOT to get their vehicles fixed, and will actively avoid VW dealers because they fear getting the fix forced on them. Since service is a key element in dealer profits these days, VW just hamstrung their dealers in the US.
-The US has no shortage of class-action ambulance chasers.
