A pregnant woman in Texas told police that her unborn child counted as an additional passenger after being cited for driving alone in a high-occupancy vehicle (HOV) lane, offering up a potentially clever defense for motorists navigating the legal landscape following the supreme court’s striking down of nationwide abortion rights last month.

interesting argument. Could a pregnant woman, boarding a flight in Texas, be charged for two seats?

Flying from texas to another shithole state, yep two seats.

Either that or none, no seats citing flying may be a risk to the
pre-child. Or maybe the woman is going to a disallowed
abortion state.

The current opinions of Texas lawyers are pretty wide ranging. The mast basic issue is the Texas Transportation Code doesn’t match the Penal Code on personhood. Until the Lege matches the two up, fun little edge cases like this will generate plenty of billable hours for someone. The Officer said it didn’t count unless the second person was outside her body, which makes some interesting possibilities…how much outside? If a couple are copulating in a vehicle in the HOV lane, are they then just a single occupant under this troopers view? Fun, fun, fun.
