Self-Defense in the Show-Me State

ST. LOUIS • A woman who stepped out of the 7-Eleven where she worked for a smoke break found herself in a shootout early Monday when an armed man tried to rob her.

She pulled out a gun and exchanged fire with the would-be robber.

The 30-year-old robber was shot in the chest, arm and thigh, police said. He died from his injuries at St. Louis University Hospital.

The 35-year-old woman, whom police have not named, was shot twice in the leg. Police said the woman was conscious and breathing when she was taken to a hospital, where she was stable.
If that's what happened, then patch her up and give her a medal.

The Law demands workers have breaks, even though as a mechanic I have found many, many ways that employers go around that.
What the law leaves open is the area where you can take a break.
Congrats to this woman for not being a victim but isn't her employer at least partially responsible for not providing a break area?
I might think that would cancel out her use of self defense at her place of work?
But, you're the lawyer, not me.

w3ski, don't know. Maybe issues of also not providing a safe break area. Still, corporate America largely seems to prefer dealing with issues regarding dead employees rather than issues regarding employees who kill robbers.

I suspect Corporate America's preference is anything that they can throw lawyers at...hence firing people, no safe areas, chemical exposure, et al.

If they have a break area they probably don't allow smoking , Is there any where in North America where non-smokers have to share space with smokers ?
