Charge Kavanaugh With Lying to Congress

In response to questions about his stance on abortion from Sen. Dianne Feinstein, Judge Brett Kavanaugh, President Trump’s Supreme Court nominee, called Roe v. Wade — the 1973 Supreme Court decision that legalized abortion nationwide — “settled Supreme Court precedent” that has been “reaffirmed many times” over the years.

Wednesday was the second day of Kavanaugh’s confirmation hearing, and the senators' opening questions revolved around three issues: Kavanaugh’s beliefs regarding the extent of presidential power, gun control, and abortion.

Is Roe v. Wade “settled law,” Feinstein asked Kavanaugh, “or can it be overturned?”

“It is settled as precedent under the Supreme Court,” Kavanaugh responded. “One of the important things to keep in mind about Roe v. Wade is it has been reaffirmed many times over the years, as you know.”

Kavanaugh was clearly lying to Congress. Charge his dead ass.

Justice Sotomayor had something to say about the abortion argument:

[Justice Sonya] Sotomayor, while grilling the attorney backing the Mississippi law during oral arguments, suggested the court would be perceived as highly politicized were it to undermine the 1973 decision in Roe v. Wade and related rulings and that such a decision would be viewed as merely a reflection of the court’s new lopsided 6-3 conservative majority.

“Will this institution survive the stench that this creates in the public perception that the Constitution and its reading are just political acts?” she asked. “I don't see how it is possible.”

With all due respect, Madame Justice, that ship has sailed. The Court's repeated gutting of the Voting Rights Act showed that the conservative majority is more than happy to make rulings aimed at benefitting the Confederacy Party. They eagerly embraced the fiction that money is speech. The California large-capacity magazine ban was upheld by a party-line vote on the Ninth Circuit. The protestations by the judges and justices that they "only call balls and strikes" is bullshit. Their calls serve their party, their ideology.

If the Court overturns Roe, regardless of the presumably high-minded rationale that will be given in the majority opinion, it will be a nakedly political act.

There will be women who will have problem pregancies, where the best treatment will be an abortion, but the doctors won't do it for they'll be afraid of being prosecuted. Because of that medical inaction, the patients will die.

That is a certainty. When it does happen, the names of those women will be hung around the necks of the justicies and politicians from the Party of Death. You can bet heavily on that.
