Moe, given that it's pretty much SOP in NYC for the NYPD to rigorously apply WWB and that the odds were pretty poor that he'd have been treated at all fairly by the cops, it was excusable of him to run. Might not have been smart or legal, but it was understanable.

Drunk guy bumped into the diner- diner tried to steady him- drunk guy said “This n----r wants to fight me,”, and the diner punched him out.
If that is accurate, drunk guy is indeed an asshole, but the diner most certainly committed an arrestable offense, while drunk-guy did not.
Drunk guy most definitely deserved getting popped one, but life ain't fair that way.
