"The Fact That You Would Say Such a Thing Just Goes to Prove That You Are the Leading Asshole in the State!"-- Abbott Ed.

When asked why the Texas All Hail the Cult of the Fetus law doesn't make an exemption for rape or incest, the fool sitting in the governor's chair had this to say:

"Let's make something very clear, rape is a crime, and Texas will work tirelessly to make sure that we eliminate all rapists from the streets of Texas by aggressively going out and arresting them and prosecuting them and getting them off the streets," Abbott stated. "So, goal number one in the state of Texas is to eliminate rape, so that no woman no person will be a victim of rape."

That is so mind-boggling stupid that one wonders how Abbott has managed to master the ability to make intelligible sounds with his mouth. First off, there is no pre-crime unit operating in Texas. For someone to be convicted of rape, they first have to, you know, rape somebody. Aggressively prosecuting the crime of murder hasn't made Texas a homicide-free state.

Second, anyone who even thinks that prosecuting and jailing rapists is a top priority in Texas, or anywhere else, has been doing some powerful drugs. I would be willing to wager that, just like most other states, there are untested rape kits sitting on the evidence shelves in Texas.

Third, the only time Southern states, like Texas, historically cared about rape was when the victim was white and the accused perpetrator was Black. Then they tended to lynch them and, if not, execute them, because the death penalty for rape was a product of the former Confederate states.

Women in Texas may wind up going to Mexico.

If you are a woman then Texas messes with you whether you mess with Texas or not. As we said in the army in 1969, 'fuckin goat ropers'.

Charlie Pierce asked a good question: if Abbott can end all rapes, why hasn’t he done it already?

And we have the potential case.

Grendel's Bar Massachusetts.

MA at that time up to 1982 delegated the authority for a
liquor license to the church nearest to the proposed bar.

The case was decided i favor of the bar that such delegation
of an authority reserved for the government is not constitutional.
Seems there are several reasons that is not permitted in the
constitution.

The federal suit is then established and has double penalty
plus cost despite the status of the states claim.

What that meas is of Jane Q Person launches the bounty
claim they can be taken to a federal court and they will
likely lose suffers greater penalty. Therefore has the
same implied threat with the proviso of go ahead sue me
for a dollar or millions, game on.

So at the federal level the best path is being reviewed
and any state considering the possibility of doing said
same is potentially at risk to adopt that. ITs more
when, not if.

To me Texas took the Dirty Harry bet in the legal sense;
"Go ahead, make my day".

Gee, he didn't say anything about preventing incest.

I'd love to know, how they will prevent rape?

The problem of rape is every law and "treatment"
is after the offense as we have no working or
valid precrime or prevention laws.

Lets take this out of the abstract or it only
happens to others.

How would you feel if (insert some bad sex thing here)
happened to you wife or daughter? How much worse
would it be for all if the result was pregnancy?

Good catch, Eck!, I forgot about Grendel Den. On rape and incest, the cruelty is the point, isn’t it?

Doug,

Actually it was Rachael Maddow and guest Laurence Tribe
as he brought at won the case.

As a point of note I looked at 18 .242 and 248 as a matter
of federal law its already prohibited. Further just telling
someone a service may be available is protected speech.
A case of so much fail and somany laws broken.

If there is such thing as precrime the law and its enforcers
are already in trouble.

Those that do not learn and understand history will be doomed
to repeat it.

Abbott by the #'s::As of February 2021, there were over 6,100 unprocessed rape kits in Texas.
Greg Abbott has been Governor of Texas since 2015... and was Attorney General of Texas before that since 2002.
In case anybody is curious how serious Abbott is on "eliminating" rape in Texas.

Thank you, Eck! I'll let you keep the credit! A former colleague would call all of this a clusterfuck. so many live in this imaginary world. But it just adds to the file labelled "I don't give a fuck about actual governing."

If Molly Ivins was till around, she'd be suggesting standing Abbott up the corner and watering him twice a week.

He is going to prevent rape the same way you change the direction of a hurricane, with a Sharpie.

I saw it suggested today that "eliminating rape" for them will mean redefining it until they can claim it doesn't happen. See also: Akin, Todd; Conway, Kellyanne.

Diug, that’s probabky what Abbott has in mind. They’ll require sworn testimony of two witnesses, who have no connection to the victim. Victims who make allegations of rape without those witnesses will be imprisoned.

Problem solved.
