OhMiGawd! They Killed Kenny! Those Bastards!

A man is dead and a woman was injured after the owner of a stolen truck shot at them while trying to recover his vehicle on the South Side, according to San Antonio Police Chief William McManus.

The owner tracked his stolen pickup truck to a parking lot at South Park Mall on Thursday afternoon.

As far as I know state laws vary a bit in shooting to defend or recover your property. Where I live if you you shoot someone attempting to take your vehicle it better be in an attached garage or you better be able to prove that the person attacked you. On the other hand I remember some years ago a case where a repo-man was driving away in a recovered vehicle and from a distance the "owner" shot through the back of the cab from a distance with a rifle, killing the repo-man. He was found innocent in Texas. Personally I believe he no longer owned the truck, by the contact he signed, when he quit paying for it.

If the story is accurate, the owner of the truck was attempting to detain the thieves. It was one of the thieves who elevated things to a shooting situation. In most states, the truck's owner would be cleared. YMMV in NY,MA,CT,NJ,IL and CA.

For cases like this, perhaps a clarifying question to ask would be "if the cops did that, would it be deemed a justified use of deadly force, or not? Granted, what is legal for a civilian in any given state may not sync up with what the police guidelines are.

Also: what was beyond the stolen vehicle, but within deadly range of the firearm? Risking the lives of others in defense of property is generally frowned upon.
