Since Republicans were blaming Joe Biden for anything and everything that happened in the country during his presidency, the Felonious Irange Shitbag owns this crash.
And so do the two Fox News white guys that he hired for Secretary of Sefense and Secretary of Transportation. Because, and let's be clear about this, the only qualifications that those two worthies had for their jobs was the fact that, like him, they were incompetent straight white men on TV.

Months before Wednesday night’s fatal midair collision of an American Airlines passenger jet and an Army helicopter in Washington, lawmakers brushed off safety warnings amid midflight near-misses and passed an industry-backed measure designed to add additional flight traffic at the same D.C. airport where the Jan. 29 disaster unfolded.
Soon after a March 2023 near collision at Ronald Reagan Washington National Airport, House lawmakers considered a provision to increase the number of flights allowed at the facility. It is one of only two airports in the country owned by the federal government, giving Congress unique authority over its operations.
The legislation was supported by lawmakers seeking more direct flights to their home states and airlines eager for expanded routes. It was opposed by lawmakers who asserted that the airport was already overstressed by flight volume in the capital region’s busy airspace.
“The bill just proposed would go far beyond past attempts to expand slots at [the Reagan Airport], dangerously overloading the airport’s operational capacity to benefit one airline,” Rep. Don Beyer (D-Va.) told the Washington Post at the time. “The very title of the ‘Direct Access To The Capital Act’ gives the game away that this bill is written to maximize the personal convenience of a comparatively small number of powerful, well-connected individuals at the expense of safety and efficiency of flights — which should be our top priority.”

Listened to the tapes and watched a bunch of videos. Blaming
the airline is not applicable.
Its a problem often seen in aircraft circles and it even has a name
failure to see and avoid on the obligated aircraft aka chopper as he
was flying on visual rules by his own comments. He simply identified
the wrong plane. Some may blame the tower but towers rarely
crash and in that case was forced to permit a military vip transit.
Flying at night using visual means (no radar) is hard and in an
area with a lot of ground light and all positive identification
can be error prone. As someone that flew at night often it was
part of the pilot to use the tower resources to help identify traffic.
Now with Tacas, and ADS-B it should be easier like I said earlier
avoiding errors is part of the task.

I've flown into DCA a number of times as pax and crew. Picking the airport and other aircraft out of the cultural lighting "noise" let alone identifying the other aircraft is non-trivial. The airspace around DCA has become simpler with the closure of Bolling AFB and NAS Anacostia for air operations (except HMX-1 at Anacostia) to avoid the midair in the olden days when a proficiency flying jet ran into an airliner. May need to look at the number of helos operated by DC, US Park Police, Army, Air Force, Marines.
Before we get into "civil airspace" versus "military national security airspace" look at the statutes and see that it is the Federal Aviation Administration not the Civil Aviation Administration. All the navigable airspace is the responsibility of the FAA, who allocates appropriate blocks of it to military, research, and other uses. And relative to the graphic the FAA has an Administrator, not a director.
