A New York judge ruled Monday that "stop-and-frisk" searches carried out by city police are unconstitutional – and ordered that a federal monitor be brought in to oversee their reform.I haven't read the ruling and to be frank, unless somebody pays me to, I'm not about to dive into a 39-page order with an accompanying 195-page ruling, even if it is double-spaced.
In a major victory for civil rights activists who have long contended that stop-and-frisk amounts to racial profiling, US district court judge Shira Scheindlin said the stops violated individuals' right to privacy and equal treatment under the law.
She added that testimony had led her to believe that the NYPD carries out more stops of black and Hispanic residents, "even when other relevant variables are held constant".
The testilying of the NYPD on this matter is legendary. The cops routinely put down that they saw a "furtive movement" or some other bullshit as a justification for the stop.

I don't know for sure if stop and frisk is done in a racist manner...but if it is, that's only additional reasons it is wrong. A huge problem is that systematic violations of enumerated rights result in not much more than "Stop--and I mean it this time". Plenty of people involved know it is wrong, but they also know they have qualified immunity--so violating someone's rights is much better than getting fired for not violating them.

ReplyDeleteIn fact, the NYPD persecutes cops who don't stop and frisk enough people. The NPR/Chicago Public Radio Program "This American Life" did a piece which included the surreptitiously-recorded arrest of a "rogue cop" named Adrian Schoolcraft who was rogue because he refused to bust people for nothing, and because he committed the unforgivable sin of recording the sins of his superiors.
