The 11th Circuit Court of Appeals essentially said so. Two juries, both comprised overwhemingly of white people, disagreed with the findings of the
sheet-wearing black robed jurists of the 11th Circuit.
Talk about your "activist judges", substituting their own views for those of two juries.
