On Wednesday, Nyah Mway finished middle school in the central New York city where his family moved about a decade ago as refugees from Myanmar, relatives said.
By Friday night, the 13-year-old was fatally shot by police who’d tackled him to the ground after he allegedly pointed what turned out to be a BB gun at them during a foot chase.
Struggling to comprehend his death, his anguished relatives and outraged members of their immigrant community called Sunday for justice for him and accountability for police.
Sure, let's have some accountability. Let's look hard at the kid's legal guardian9s), who knew or should have known that their child was running around the streets at night with a BB gun that was indistinguishable from a Glock 17.
The cops do a lot of dumb or bad things. Any frequent reader of this blog knows that I've not been shy about pointing that out.
But here, a kid pointed a gun at the cops. And if you do that, the cops are not going to wait to see whether or not it's a replica, a BB gun or the real thing. They are not going to wait to get shot.
You point a gun at the cops and they are going to light your ass up. If you're old enough to fuck around and point a gun at the cops, you're old enough to find out what it's like to get shot.
Do stupid things and find out what happens.

consider them toys. They can do real damage. However if
you don't know what it is assume its real and deadly.
Further running from a cop, show a replica, or any gun is
at the extreme unwise bordering on stupid.
In most cities simply being in possession of a "bb gun"
in an unsecured case is considered criminal.

ReplyDeleteI found the police pictures of the handgun. Had to hunt for it
ReplyDeleteand what I saw was on face a Glock, enlarged you could see the
markings that make it a CO2 pistol.
Glock Gen5 .177 (4.5mm) is a 26oz replica of the G19. The mag
is really where the co2 cartridge is located.
There appears to be two versions one a BB repeater at 350fps with
working slide that cycles. The other is pellet at 410fps also
working slide. I cannot confirm is they are different or same
thing with munged adverts. The accuracy is all markings save
for the license by Glock to Umarex in the plastic grip. Even
has the "serial number" in the correct place.
If found on the ground I'd immediacy treat it as real. Until
clearing it and ejecting the mag, seeing CO2 cartidge, its
real enough to be concerning.
There are a number of replica pellet or BB guns available
even a 1911.
NOTE only Airsoft or similar low power simulations have the
orange barrel end.
So real until proven otherwise applies. FYI getting hit by a
.177 pellet at that power level has the ability to penetrate
skin.
Still begs the question about shooting the kid.

I see the kid point the guy…I then see the cop has the kid on the ground and is punching him…then cop #2 shoots the kid. It is not clear where the gun is at that point, but the failure of police to release a video from showing the gun pointed at police while the kid is on the ground is concerning. I’ve got a nasty feeling this will turn out to be cop #2 seeing what he expected to see…and acting. Certainly this will take more investigation…and the Utica police should NOT be running the investigation at this point, it should be at least NYSP BCI.
