Make no mistake about it,: Trump's declaration of a national emergency is nothing of the sort. It is a power grab. It is a blatant attempt to nullify the right of the Congress to appropriate money for specific purposes. Trump lost a political battle and he is now going to wreck the entire idea of checks and balances, the bedrock of our freedoms, in order to get his fucking wall.
There would be nothing to stop a future president from saying "I'll take money from the Energy Department in order to establish a national handgun registry" and send out the AFT to scan every ATF Form 4473 into a database. Or shift money from the F-35 to battle climate change. Or fund Medicaid expansion, mass-transit systems, whatever a future president wants to do. All he or she would have to do is utter the magic phrase "I am declaring a national emergency" and presto! the Constitution evaporates.
If this stands, the budget bill, in the future, might as well be as short as "here's X.X x 10^12 dollars".
If you support Trump on this, you are neither a conservative nor a Republican. You are an authoritarian, someone who would have supported King George III during the Revolution. (Or you are a despicable politician who care for nothing but his own neck, like Mitch McConnell.)
In other words: A traitor. Just like King Donald the Nutter.
It will be most interesting to see the Judicial trail on this one. We have a pretty clear Consititutional issue here with the spending decisions clearly allocated to Congress, not El Jefe. There is also the provision they are likely to use in the 1976 Emerency Powers law that allow reallocation of unobligated military funds for different projects, however it also stipulates those projects must aid military preparedness.

This was a power play, pure and simple. Republicans AND Democrats, for some reason, put the safety,security and economic stability of the United States Citizens (especially blacks) second to the latino invaders. Why is that?
Having said that, I hope Donnie loses in court. The precedent would be bad and have terrible possibilities for when some liberal weasel gets power.

Trump is, at least, trying to uphold the security of the United States and the Citizens thereof...Rather than sell out the countries security for votes and power.
OK, game on. Fire up the court challenges, and use this not as precedent for more subversion of the constitution, but as ammo to beat both Fergus and McConnell next year.

Fergus Tweeted that invoking the 25th amendment would be unconstitutional, so he should have his forehead stamped with the word "moron" and be escorted off of the white house property and never allowed to return.

ReplyDeleteIf you look into the ones that Obama actually declared, what he did was send money to a number of countries, that were not getting it before. So in effect, he was spending money that was allocated for another purpose, and diverting it to a place that he felt was more deserving. Sort of what the current president wants to do.
And never doubt that in one way or another the president will prevail. One of the most important jobs the president and the Executive branch has is to protect the people. I have no problem with the president doing that. Why so many people, who used to speak so strongly against illegal immigration, like, oh, say Bill Clinton and Barrack Obama, now come out as wanting to allow all the immigrants to come in, no matter what, is a puzzle.
PigPen, if you look at the emergencies that Obama declared, they are consistent with the ones that other presidents had done: To sanction foreign governments, entities and foreigners who were doing disagreeable things.
ReplyDeleteTrump may not prevail, He declared a national emergency because he lost a political fight with the Congress, the entity that under our system has the power of the purse. Trump said, in his Rose Garden announcement, that he really didn't need to declare an emergency.
There is no emergency. There is Trump who admits that he was doing this to please Hannity and Limbaugh. Whether or not the courts will take that into account is another question. But the Supremes tend to take the whole separation of powers bit seriously, so the chances are not as good as you think.
Pigpen, I took a look at the list of national emergencies so thoughtfully provided by Comrade Misfit. Are you sure you read the same list I did? Every sanction imposed by former President Obama started with the words 'Blocking property and assets' for countries where horrible human rights violations were taking place. The one exception addressed the H1N1 Influenza pandemic. Where does it say he sent monies?
