Authorities said a Texas teenager serving probation for killing four people in a drunken-driving wreck after invoking an "affluenza" defense was in custody in Mexico, weeks after he and his mother disappeared.The first judge "retired" after sentencing that Young Asshat to probation after he killed four people. Hopefully, the next judge will be a little more resistant to the arguments of Asshat's lawyers. For his family has the money for the best.
Mexico's Jalisco state prosecutors' office said in a statement that its agents had been working with American authorities via the U.S. Consulate in Guadalajara since Dec. 26 to track down and capture 18-year-old Ethan Couch and his mother, Tonya Couch. The office said the two were located and detained Monday evening in a beachside neighborhood of the Pacific Coast resort city of Puerto Vallarta.
His mom might be in a little more trouble than Asshat is. Tango sierra.

ReplyDeleteThey are still white as cottage cheese, so it will be a 'first offense" (for fleeing) penalty. Since the family is wealthy, mom and son may get a stern talking to with an admonishment to not do it again, 'or else'!
ReplyDeleteThe breaking of probation with the beer pong video will be a separate matter, and since the kid is still while and wealthy, he will probably be fined for his noncompliance with the terms of his parole, and strongly admonished not to do it again, or at least make sure there is no video evidence...
Actually, the current problem is that his probation/sentence is within the Texas juvenile system. Even revoking his probation, he would be released in April of 2016, when he turns 19. They are petitioning the court to move Couch To the adult system, which would result in a little less than 8 years in jail on he violation of the terms (if proven). What isn't clear to me is how a 18 year-old who skips on his juvi probation is treated for the skip, is it up also in the juvi system, or in the adult system.
ReplyDeleteAmusingly, it seems the idiot gave himself away with a cell phone. They weren't in a nice, tourist hotel, it turned out....I was surprised. The mother now has an arrest warrant out too.
Latest report suggests up to 120 days is the penalty for running on probation, but that's exclusive of any result from revocation. Second violation would open up a 40-year sentence for the original crime...but the screwy Texas juvi rules still apply. No word on the sentence(s) Tonya is looking at.

ReplyDeleteYoung Asshole faces an interesting series of options. No additional punishment for skipping probation as a juvenile. Revoking (juvi) probation would mean jail (juvi) till mid-April, 2016, that's it. Move to adult system would result in release on probation under adult system, after up to 120 days in jail for running. Second violation would result in serving his 4 10-year terms, not clear if they would automatically be stacked, and not clear if there would be any reduction for probation time served.
Old Asshole faces 2 to 10 years for "hindering arrest". No betting line on if she'll serve anything.
Anyone at the "going away party" should be prosecuted, but I suspect there's no way to do it. And they gave themselves away when they ordered pizza to their condo.

ReplyDeleteI know they ain't smart. She's back in the US, with her lawyer saying she ain't done nothing wrong...I expect that to go over very poorly with the court. He's in a Mexican immigration jail, and fighting to delay his return. Makes me think his lawyers think if they can draw this beyond April 11 and his 19th birthday, with him in Mexico, it'll all go away. Where the hell they get that idea, I don't know, but apparently even money doesn't alway buy a smart attorney. Of course, we may all be wrong and they may both walk.
